Coffee Cubed is a completely online business that has a manufacturing plant and storage facility located in New York. At those facilities, Coffee Cubed has a special relationship with those employed in those facilities to ensure that they don't get hurt and to provide them with a great working environment.

Torts

Our business is exposed to product liability claims because of possible manufacturing defects. The plaintiff would have to prove that

The product was in a defective condition when the company sells it
The product was unreasonably dangerous to the plaintiff because of the defect
The plaintiff must prove injury
The plaintiff must show the proximate cause of the injury

No other strict liability claims apply to my business

Foreseeable Circumstances

1) Someone can sue my business if the coffee cubes were defective. For example, the cubes were made with sour milk which caused a customer to get extremely sick. The customer can sue my business for negligence.

Duty of Care: Coffee Cubed is responsible for selling a product that won't cause harm to an individual

Breach: Coffee Cubed sold a defective product causing a customer to get sick

Causation: The chain of events that led the customer to get sick is as follows. Coffee Cubed received milk from the supplier and at that time was expired. Not knowing, that same milk was used for the production of the Coffee Cubes. As a result, when the customer went to drink the coffee they immediately got sick due to the expired milk in our product. The injury was foreseeable because expired milk can get someone sick.

Damages: The customers ended up in the hospital for a week.

How we can avoid this in the future: We need to train our employees to look at the ingredients and make sure it is to our standard. We also should go with a more reputable supplier

Intentional Torts

An intentional tort that one of my employees can commit against my business could be trespass to land. After business hours when the storage facility is locked, employees that come back can face trespass. No employees are permitted to go back to the storage facility after hours as per their contract. If an employee needs to go back and get something from the office, they must wait until the following business day. This is in place so that theft and destruction of company property do not occur. Under agency law and intentional torts, the employee would be legally responsible.

Another intentional tort that one of my employees can commit against my business is Defamation. Defamation is the publication of untrue statements that disparage a business owner's company or product that can result in economical injury. This can occur when an employee of Coffee Cube makes false accusations that the company supports the rising of the KKK. This in turn might cause economic injury as customers will refuse to buy from a company that backs a terrorist organization. The employee will be held accountable for a violation of their contract as well as committing an intentional tort against the company that causes economical damage.

2) An employee can sue my company for negligence after they fell in my storage facility due to a water leak. Our cleaning staff mopped up the water without realizing there was a leak and assumed it was just from someone dropping some water on the floor.

Duty of Care: To provide my employees with a safe working environment

Breach: The company breached its duty of care by not protecting its employees.

Causation: Due to the companies negligence in not putting up a wet floor sign, one of our employees go hurt on the job. The injury was foreseeable since the ground was wet and no wet floor sign was present

Damages: The employee broke their ankle and was in a cast for six months.

How we can avoid this in the future: Proper training of our staff members can help the company in the future. This event could have been avoided if the cleaning staff had seen the leak and notified management and put a wet floor sign on the wet surface.
