Implied Authority

Alyssa Eastro would have the implied authority to sign contracts on my behalf because she is my Chief Executive Officer that is in charge of running the business. I am simply the founder of the idea and have no business background hence, I have a CEO.

Is the company responsible? 

The company can be liable for our employees in a number of different ways.

 

Alyssa Estro (CEO): has implied authority to sign contacts on my behalf. The company could be liable for her behavior since she had implied authority.

Other Employees: If my employees caused harm to other individuals, the business can be held liable under the following conditions. 

  • If our employees were pursuing reasonable expected personal interests during their negligence 

  • If our employees were acting within the scope of employment during the time of their negligence 

In addition, if the employees caused harm to other individuals caused by an intentional tort, the business can be held liable under the following conditions 

  • If our employees were motivated by the companies best interests

  • If the intentional tort occurred in a work-related space

Who would most likely make my company liability?

 

The employees that will bring this company the most liability are our manufacturing employees. If our product gets anyone sick our company is responsible. If there is an ingredient in our coffee that expired and manufacturing employees forgot to check, our company can be sued for negligence.

Anti Discrimination Laws

Coffee Cubed is required to follow both the ADA and ADEA. We are not required to follow Title VII because our firm is limited to just 10 employees and Title VII needs us to have at least 15 employees to require us to follow that law. We are also considered independent contracts, which means that we don't have to follow Title VII because it only applies to governments, colleges, universities, employment agencies, and labor organizations, etc. In the state of New York, they have a similar law to Title VII. So although we are not required to follow Title VII, we are required to follow the New York Human Rights Law. I will make sure my business complies with all the applicable laws by training my entire staff to look out for the types of behavior stated in these laws in the workplace. In addition, my hiring team will be required to have to take a course to go over all of these laws to ensure that when we are hiring new employees we are not breaking those laws
